Woman says Corinthian Colleges violated consumer credit act

HUNTINGTON – A woman is suing Corinthian Colleges, Inc., after she claims it violated the West Virginia Consumer Credit and Protection Act and harassed her.

Corinthian Colleges, Inc. is doing business as Everest Institute.

The defendant is a debt collector and engages directly or indirectly in debt collection within the state of West Virginia, including Raleigh County, according to a complaint filed Feb. 11 in Cabell Circuit Court.

Kristina Robinson claims she does not owe any debt to the defendant or any of its subsidiaries.

The defendant began to engage in collection of alleged indebtedness through the use of telephone calls placed to Robinson, by written communications and did otherwise communicate with her to collect debts it alleges are hers, according to the suit.

Robinson claims she retained counsel to represent her interest in connection with the consumer indebtedness and informed the defendant of her representation.

Despite its knowledge of her being represented by counsel, the defendant continued to attempt to communicate with Robinson, according to the suit.

Robinson claims the defendant’s actions violate the West Virginia Consumer Credit and Protection Act and are negligent.

The defendant’s conduct was done with the intent to harass Robinson and, as a result of its conduct, she has been annoyed, inconvenienced, harassed, bothered, upset, angered, harangued and otherwise was caused indignation and distress, according to the suit.

Robinson is seeking compensatory and punitive damages. She is being represented by Hoyt Glazer of Legal Aid of West Virginia.

The case has been assigned to Circuit Judge F. Jane Hustead.
