Woman blames Wal-Mart for injuries

WAYNE – A Wayne woman is suing Wal-Mart after she claims she sustained injuries on its property.

USM, a/k/a John Doe corporation or individual or other artificial entity; T&L Services of Alum Creek, LLC a/k/a T&L Services, LLC; Dirt Busters Services; Mark Perry; William Zirkle; Terry Zirkle; John Doe Corporation or other unknown individual or other artificial entity; Wal-Mart Stores East I; and other Wal-Mart entities.

On Feb. 8, 2011, Paula Swimm was at the Wal-Mart in Wayne and was walking across its parking lot when she slipped, fell and was injured, according to a complaint filed Feb. 8 in Wayne Circuit Court.

Swimm claims the defendants had a duty to exercise reasonable care to protect her from injury on the premises and failed to do so.

The defendants were aware of the hazardous condition in the parking lot and allowed it to remain wet, snowy, icy, oily, slippery, slick and otherwise unsafe, according to the suit.

Swimm claims the defendants caused her to sustain severe injuries to her head, neck, back, hips, legs and other parts of her body.

As a result of the defendants’ negligence, Swimm suffered pain and suffering; mental anguish; emotional trauma; and incurred medical and hospital expenses, according to the suit.

Swimm is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Scott G. Stapleton of Stapleton Law Offices.

The case has been assigned to Circuit Judge James H. Young Jr.
