WINFIELD – A man is suing three companies he claimed are responsible for injuries he suffered while performing his work duties.
Tri-State Roofing & Sheet Metal Company of West Virginia, Kokosing Construction Company, Inc., and MarkWest Energy Appalachia, LLC were named as defendants in the suit.
Shawn Arthur was employed by Tri-State Roofing, according to a complaint filed Feb. 12 in Putnam Circuit Court.
Arthur claims on July 16, he was instructed to work on a roof without fall protection, and while working on the roof, he fell approximately 25 feet to the ground and was injured.
As a result of the fall, Arthur was seriously injured and suffered severe and permanent injuries, including a 50 percent compression fracture of the T12 vertebra, severe laceration of the left wrist, fracture of the left elbow and other parts of his body, according to the suit.
Arthur claims the defendants allowed unsafe working conditions to exist and had actual knowledge of the unsafe working conditions.
Despite this knowledge, the defendants failed to take any action to stop the unsafe working condition, according to the suit.
Arthur is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Robert B. Warner and Tammy Bowles Raines of Warner Law Offices.
The case has been assigned to Circuit Judge Joseph K. Reeder.
