West Virginia Nursing Network sues Loop Plaza Pharmacy

WINFIELD – West Virginia Nursing Network, LLC is suing Loop Plaza Pharmacy Co. after it claims Loop breached its contract.

On April 3, WVNN entered into an oral contract with Loop to perform home infusion services exclusively, according to a complaint filed Feb. 14 in Putnam Circuit Court.

WVNN claims between April and July, it provided lunch during business meetings; purchased a printer and a computer; developed and printed an infusion policy and procedure manual; purchased office supplies and an office phone; filed for a new license to the Office of Health Care Quality; added infusion services to its existing liability policy; provided various services to Loop; and incurred legal services in the total amount of $40,418.04.

In stating that Loop would create infusion services “in-house” and not utilize WVNN, despite the exclusive contract, Loop materially breached its obligations arising under the contract, according to the suit.

WVNN claims Loop breached its duty owed to WVNN by withdrawing from the contract.

Loop’s misrepresentation caused significant monetary damages, among other damages, to WVNN, according to the suit.

WVNN is seeking compensatory damages with pre- and post-judgment interest. It is being represented by Bryan B. Escue of Escue and Pritt Law Office.
