HUNTINGTON – Forest Fibers, Inc., is suing Route 2 Recycling, LLC, after it claims it owes nearly $30,000 for goods and services.
Sun Down River Development and Kenneth E. Maxwell were also named as defendants in the suit.
Forest Fibers provided goods and services to the defendants in the approximate amount of $28,000, according to a complaint filed Feb. 22 in Cabell Circuit Court.
Forest Fibers claims the defendants have failed and refused to pay for the goods and services.
Maxwell provided personal assurances that the goods and services would be paid for by the defendants and Forest Fibers relied upon Maxwell’s promises, according to the suit.
Forest Fibers claims the defendants breached their contracts and caused it to suffer monetary loss, loss of income, loss, significant debt, inconvenience and loss of personal reputation.
The defendants represented that they would make payment and failed to do so, which constitutes fraud, according to the suit.
Forest Fibers is seeking compensatory damages. It is being represented by D. Adrian Hoosier II of the Hoosier Law Firm, PLLC.
The case has been assigned to Circuit Judge F. Jane Hustead.
