Former employee sues WVDOT, claims sexual harassment

CHARLESTON – A woman is suing the West Virginia Department of Transportation-Division of Highways after she claims she was sexually harassed by her supervisor.

Tim Stanley was also named as a defendant in the suit.

Stephanie McClung was employed by the WVDOT as a summer worker and Stanley was her supervisor, according to a complaint filed Feb. 25 in Kanawha Circuit Court.

McClung claims Stanley verbally and physically sexually harassed her in the workplace and created a hostile work environment.

Stanley’s conduct was open and obvious to other supervisors and McClung complained to Stanley on numerous occasions, but he continued with his inappropriate conduct, according to the suit.

McClung claims the defendants’ actions violated the West Virginia Human Rights Act by subjecting her to a hostile work environment as a result of her gender.

Stanley’s actions were outrageous and caused McClung severe emotional distress, according to the suit.

McClung is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Paul M. Stroebel of Stroebel & Johnson, PLLC.

The case has been assigned to Circuit Judge Charles E. King.
