HUNTINGTON – Two men are suing H3, LLC, after they claim it repeatedly violated the Fair Labor Standards Act and the Maximum Hours Standards Act.
Robert W. Plybon and Chad Robinson were employed by H3, according to two complaints filed March 7 in Cabell Circuit Court.
The plaintiffs claim during the time they have been employed by H3, it has repeatedly violated the Fair Labor Standards Act by having them work longer than 40 hours per week without compensating them for overtime.
From the time the plaintiffs began working for the defendant through the present, the defendant has repeatedly violated West Virginia code by failing to make, keep and preserve adequate records of their wages, hours and other conditions of their employments, according to the suits.
Plybon and Robinson are seeking judgment pursuant to the Fair Labor Standards Act and the Maximum Hours Standards Act. They are being represented by Paul E. Biser of Fredeking & Fredeking Law Offices.
The cases have been assigned to Circuit Judge David M. Pancake.
