Couple sue Discover Bank, allege illegal debt collection

HUNTINGTON – Discover Bank is being sued after a couple claim it attempted to collect an alleged debt from them even after they informed the bank they were being represented by counsel.

Keith Blake and Crystal Blake became in arrears upon an alleged indebtedness to the defendant and they retained legal counsel to represent them in connection with consumer indebtedness, according to a complaint filed Feb. 28 in Cabell Circuit Court.

The Blakes claim despite informing Discover about being represented by counsel, it continued to attempt to contact them in violation of the West Virginia Consumer Credit and Protection Act.

Discover engaged in repeated violations of the WVCCPA and caused the Blakes to be annoyed, inconvenienced, harassed, bothered, upset, angered and harangued, according to the suit.

The Blakes claim the defendant negligently failed to train, supervise, monitor and otherwise control its employees to ensure that its employees did not violate the WVCCPA.

As a result of the defendant’s actions, the Blakes suffered emotional distress and Discover invaded, damaged and harmed their right of privacy, according to the suit.

The Blakes are seeking compensatory and punitive damages. They are being represented by Scott G. Stapleton of Stapleton Law Offices.

The case has been assigned to Circuit Judge David M. Pancake.
