Hunt Construction Group, employee sued over alleged dog attack

CHARLESTON – A woman is suing Hunt Construction Group, Inc., and one of its employees after she was attacked by a dog.

On March 3, 2011, Lorraine McCallister was exiting a restaurant when she encountered C.L. Cross and his dog, according to a complaint filed March 1 in Kanawha Circuit Court.

McCallister claims the dog bit her without provocation and Cross refused to disclose to her the status of the dog’s rabies vaccinations, despite her request.

At the time of the incident, Cross was acting in the scope of his employment with Hunt, according to the suit.

McCallister claims Cross failed to adequately control and restrain the dog so as to prevent it from biting others in a public place.

Hunt negligently failed to implement and/or enforce policies and procedures to prevent and/or restrict Cross from using a company vehicle to transport a dog with a propensity to bite people to a public place, according to the suit.

McCallister claims Hunt’s negligence created an unreasonable risk of harm to her and to others.

As a result of the defendants’ negligence, McCallister sustained physical injury; physical impairment; physical pain and suffering; mental pain and anguish; medical and travel expense; annoyance and inconvenience; and loss of enjoyment of life, according to the suit.

McCallister is seeking judgment in the amount of $25,000 with pre- and post-judgment interest. She is being represented by Henry R. Glass III of Glass Law Offices.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
