*Plaintiff claims that on Sept. 9, 2011 he was in a golf cart driven by O'Brien at the Cress Creek Golf Club. Going around a curve, O'Brien lost control of cart, which traveled down a15-foot embankment, injuring plaintiff. Plaintiff alleges direct negligence of O'Brien and negligence on the part of Cress Creek for failure to provide a safe course of travel.
