Man sues Ford, M&M Allietta for allegedly defective vehicle

CHARLESTON – A man is suing Ford Motor Company and M&M Allietta, Inc., after a vehicle he purchased was allegedly defective.

On March 15, 2012, John McIntosh entered into a motor vehicle purchase contract with the defendants for the purchase of a 2012 Ford F150, according to a complaint filed March 4 in Kanawha Circuit Court.

McIntosh claims after purchasing the vehicle, he discovered and experienced repeated non-conformities that substantially impaired the use, value and/or safety of the vehicle.

As a result, McIntosh returned the vehicle to the defendants for repair on at least eight occasions, but, despite his efforts to allow the defendants the opportunity to repair the vehicle, they failed to do so, according to the suit.

McIntosh claims the defendants failed and refused to provide a comparable replacement vehicle and failed to reimburse him pursuant to his rights under state law.

The defendants’ actions were willful, wanton and/or carried out with reckless disregard for McIntosh’s rights, according to the suit.

McIntosh is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Kristina Thomas Whiteaker, D. Christopher Hedges and David L. Grubb of the Grubb Law Group.

The case has been assigned to Circuit Judge Carrie Webster.
