MORGANTOWN – A New Jersey man is suing Ohana Enterprises, LLC, after he claims he was battered by one of its employees and was injured.
Ohana Enterprises is formally known as Ohana Beach Bar and is currently doing business as Whisper at Ky’s.
Bernie Sousa and John Doe were also named as defendants in the suit.
On March 8, 2011, Brian Albert was at Ohana when he was intentionally, negligently, carelessly, recklessly and/or maliciously battered and/or injured by Doe, according to a complaint filed in Monongalia Circuit Court.
Albert claims Doe put him into a headlock until he lost consciousness and then threw him on the pavement outside of the bar.
The defendants’ actions caused Albert to suffer doctor, hospital, dental work and other medical bills; lost wages; pain, suffering, psychological damage and mental anguish; and loss of the ability to enjoy life and pursue his normal work and recreational pursuits, according to the suit.
Albert claims Doe was acting in the scope of his employment with Ohana when he caused the injuries.
Sousa is Ohana’s owner and liable for Doe’s actions, according to the suit.
Albert is seeking compensatory and punitive damages. He is being represented by John B. Brooks of the Law Offices of John B. Brooks.
