HUNTINGTON – A woman is suing Quality Magnetite LLC after she says she was injured in a car accident caused by one of its employees.
Joseph Crisel, an employee of Quality, was also named as a defendant in the suit.
On Aug. 23, 2011, Mary Morgan Wise was operating a 2001 Honda Civic and was traveling westbound on U.S. 60 near the First Street intersection in Huntington, according to a complaint filed March 13 in Cabell Circuit Court.
Wise claims while she was traveling westbound, Crisel, who was operating a 1997 Ford F350 owned by Quality, improperly crossed U.S. 60, also known as Third Avenue, and collided with the driver’s side of her vehicle.
The Uniform Traffic Crash Report and investigating officer, G.T. Queen of the Huntington Police Department, placed fault solely on Crisel failing to yield the right of way and directly causing the collision, according to the suit.
Wise claims the defendants’ negligent, careless, reckless and unlawful acts and omissions caused her serious permanent injuries and damages.
The defendants’ actions caused Wise to sustain extreme physical pain and suffering; extreme mental anguish and suffering; medical bills; permanent physical impairment; lost wages; loss of future earning capacity; loss of capacity to enjoy life and engage in her normal activities; and annoyance and inconvenience, according to the suit.
Wise is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by J. Ryan Stewart of Bucci Bailey & Javins.
The case has been assigned to Circuit Judge David M. Pancake.
