Office of Economic Opportunity resolves wrongful termination lawsuit

CHARLESTON - A lawsuit involving the West Virginia Governor's Office of Economic Opportunity and a former employee who claimed she was wrongfully terminated has been dismissed from court.

Kelly C. Davis was employed by the defendant and claimed she consistently performed her duties in a satisfactory manner and met its reasonable expectations, according to the complaint filed Jan. 21, 2011, in Kanawha Circuit Court.

Davis claimed on Nov. 10, 2010, the defendant willfully, maliciously and unlawfully terminated her employment and caused her indignity, embarrassment and humiliation.

On Aug. 10, Mediator Frank T. Litton Jr. announced to the court that the parties had resolved all issues in controversy during a mediation conducted on Aug. 8, according to a mediation outcome report.

On Oct. 2, the parties reached a settlement of all claims Davis brought against the defendant, its successors and their insurers.

Davis was being represented by Mark A. Atkinson of Atkinson & Polak. The WVGOEO was represented by Charles R. Bailey and Suleiman Oko-ogua of Bailey & Wyant.

The case was assigned to Circuit Judge James C. Stucky.
