Settlement filed in Charleston Town Center lawsuit involving injuries

CHARLESTON - A dismissal order has been filed in a lawsuit involving a man who sustained injuries at Charleston Town Center.

On July 21, 2011, Ronald L. Gillenwater II, Charleston Town Center Company LP and Forest City Commercial Management Inc. jointly represented to the court that all claims, issues and disputes among them had been fully compromised and settled, according to the dismissal order.

The dismissal order states that all claims, issues and disputes in the action that were raised or which could have been raised by Gillenwater were fully compromised, settle and agreed to by both parties. Terms were not disclosed.

On Aug. 18, 2010, Gillenwater was a customer at the Charleston Town Center and was walking on the second floor when he slipped and fell, according to a complaint filed Feb. 3, 2011, in Kanawha Circuit Court.

Gillenwater claimed that water had leaked from the roof and carelessly been left on the floor.

Gillenwater was represented by Shawn R. Romano of Romano & Associates.

The defendants were represented by Edward P. Tiffey of Tiffey Law Practice.

The case was assigned to Circuit Judge Louis Bloom.
