Man blames Nova Rubber Company for accident

CHARLESTON - A St. Albans man is suing Nova Rubber Company LLC for a car accident that allegedly caused him injuries.

On March 15, 2011, Clarence Burgess was riding as a passenger in a vehicle being driven by Thomas Bryant on Fourth Street in South Charleston, according to a complaint filed March 15 in Kanawha Circuit Court.

Burgess claims at the same time, McDonald was operating a 2005 Ford F-150 owned by Nova and collided the truck with the Bryant vehicle.

McDonald operated the vehicle in a negligent manner and caused Burgess permanent personal injuries, according to the suit.

Burgess claims Nova is liable for McDonald's actions because he was acting within the scope of his employment at the time of the accident.

As a result of the defendants' negligence, Burgess incurred damages, including medical expenses; lost income; pain and suffering; emotional distress; inconvenience; and the loss of ability to enjoy life, according to the suit.

Burgess is seeking compensatory damages with pre- and post-judgment interest. He is being represented by R. Michael Martin of Michael Martin & Associates.

The case has been assigned to Circuit Judge Jennifer Bailey.
