Couple sue over alleged hole in 7-11 parking lot

CHARLESTON - A woman and her husband are suing Prima Marketing LLC after she was injured while on its property.

Prima Marketing is doing business as Prima 7-11 and Prima 7-Eleven.

On March 13, 2011, Josephine Jackson was a business invitee at one of the defendant's stores in Charleston, according to a complaint filed March 13 in Kanawha Circuit Court.

Jackson claims when she exited the defendant's store, she stepped in a hole in the parking lot and suffered a fracture to her left metatarsal and radial head.

As a result of the defendant's negligence, Jackson suffered pain of body; mental anguish and distress; and incurred expenses for medical bills, medication and lost wages, according to the suit.

Jackson's husband, Randy Jackson, has been denied the services, support and consortium of his wife, according to the suit.

The Jacksons are seeking compensatory damages. They are being represented by Michael L. Glasser of Meyer, Ford, Glasser & Radman PLLC.

The case has been assigned to Circuit Judge James C. Stucky.
