CHARLESTON - A woman is suing the estate of a former lessee after she claims he failed to pay rent for three months.
Joe Tummons was the lessee of commercial property owned by Simone Husson, according to a complaint filed March 12 in Kanawha Circuit Court.
Husson claims the initial term of the lease agreement expired and Tummons, by extension, renewal or hold over, became a month-to-month tenant.
Tummons failed to pay rent in January, February and March, and he owed $3,600 for rent when he died on March 7, according to the suit.
Husson claims she has the right of re-entry into the commercial property due to the non-payment of rent for January, February and March.
Possession of the commercial property is being unlawfully held and there is no sufficient property subject to distress upon the premises to satisfy the claim for rent due, according to the suit.
Husson is seeking immediate possession of the property, termination of the lease agreement and $3,600 for rent that remains due and owing. She is being represented by G. Nicholas Casey Jr. and Sang Ah Koh of Lewis Glasser Casey & Rollins PLLC.
The case has been assigned to Circuit Judge Louis H. Bloom.
