CHARLESTON - A man is suing Nissan Motors America Inc. after he claims the vehicle he purchased was defective.
C&O Motors Inc. was also named as a defendant in the suit.
On July 9, 2009, Joshua Price purchased a new Nissan Cube from the defendants, according to a complaint filed March 12 in Kanawha Circuit Court.
Price claims the purchase price of the vehicle was approximately $19,450 and, in addition, he paid other costs reasonably related to the purchase of the vehicle.
After purchasing the vehicle, Price experienced repeated non-conformities with the new motor vehicle which substantially impaired the use and market value of the vehicle and reasonably causes Price to fear for his safety when operating the vehicle, according to the suit.
Price claims after a reasonable number of attempts, the defendants did not conform the vehicle to its warranty, nor did they replace the vehicle with a comparable new vehicle that did conform to the warranty.
As a result of the defendants' failure to conform the vehicle to the warranties, Price was damaged by the loss of use of the vehicle and has further suffered annoyance, inconvenience and incurred expenses for alternative transportation.
Price is seeking compensatory damages. He is being represented by Michael L. Glasser of Meyer, Ford, Glasser & Radman PLLC.
The case has been assigned to Circuit Judge Tod J. Kaufman.
