CHARLESTON - A woman is suing OneMain Financial Inc. after she claims it violated the West Virginia Consumer Credit and Protection Act.
Sheila May Elkins is indebted to the defendant and hired an attorney to represent her regarding the debts, according to a complaint filed March 20 in Kanawha Circuit Court.
Elkins claims despite informing the defendant that she was being represented by counsel, the defendant continued to contact her.
On at least 29 occasions, the defendant contacted Elkins via telephone after she had informed OneMain that she was being represented by counsel, according to the suit.
Elkins claims the defendant's actions were unlawful, violated West Virginia Code and were done with the intent to annoy, abuse or oppress her.
As a result of the defendant's negligence, Elkins has been annoyed, inconvenienced, harassed and upset, according to the suit.
Elkins is seeking compensatory and punitive damages. She is being represented by Brian R. Blickenstaff of Turner & Johns PLLC and Robin L. Godfrey.
The case has been assigned to Circuit Judge James C. Stucky.
