Woman blames City of Charleston for car accident

CHARLESTON - A woman is suing the City of Charleston after she claims it is responsible for injuries she sustained in a car accident.

Daniel Anderson, an employee of the City of Charleston, was also named as a defendant in the suit.

On May 28, 2011, Marcia R. Harrison was operating a vehicle on Washington Street in Charleston when Anderson, who was operating a Charleston-owned Dodge Durango, failed to yield the right-of-way and struck Harrison's vehicle, according to a complaint filed March 20 in Kanawha Circuit Court.

Harrison claims Anderson's overhead lights and siren were activated, but when he came to the intersection of 21st Street and Washington Street, he failed to yield the right-of-way to oncoming traffic and caused the collision with her vehicle.

As a result of the collision, Harrison sustained serious and permanent injuries, including a closed head injury, left wrist sprain, shoulder pain, neck pain and back pain, according to the suit.

Harrison claims Anderson had a duty to reasonably and safely operate the City of Charleston emergency vehicle and breached that duty by causing the collision.

The defendants' negligence also caused Harrison to suffer severe and debilitating physical injury and pain; incur substantial medical expenses; suffer mental anguish; incur property loss; and suffer permanent physical impairment and loss on enjoyment of life, according to the suit.

Harrison is seeking compensatory and punitive damages. She is being represented by Bernard E. Layne III of Mani, Ellis & Layne PLLC.

The case has been assigned to Circuit Judge Carrie Webster.
