BE&K Construction lawsuit settled

CHARLESTON - A lawsuit filed by a former employee against BE&K Construction Company LLC was settled dismissed with prejudice five months after it was filed in 2011.

Craig Baldwin was employed by BE&K until his employment was terminated on Dec. 21, 2010, according to a complaint filed Feb. 3, 2011 in Kanawha Circuit Court.

Baldwin claimed BE&K failed to pay his final employment wages owed in full within 72 hours of terminating his employment, which violated the West Virginia Wage Payment and Collection Act.

Baldwin & BE&K resolved the matter out of court and Baldwin's attorney, Todd S. Bailess of Bailess Law PLLC, informed the court that a dismissal order would be filed with the Court upon execution of a settlement release, according to a letter dated June 21, 2011, and filed in Kanawha Circuit Court.

On June 29, 2011, a Stipulation of Dismissal With Prejudice was filed.

BE&K was represented by Craig W. Snethen of Jackson Lewis LLP.

The case was assigned to Circuit Judge Louis H. Bloom.
