McMillion Research says it wasn't paid for 2012 polling

CHARLESTON - McMillion Research Services LLC is suing Middleton Market Research LLC for allegedly failing to pay more than $70,000 for polling-related services.

McMillion provided polling-related services to the defendant with respect to various elections in fall 2012, according to a complaint filed March 22 in Kanawha Circuit Court.

McMillion claims it sent invoices between March 29, 2012, and Oct. 16, 2012, totaling $94,863.75.

To date, only $$22,903.75 has been paid, leaving a balance of $71,960 on Middleton's account with McMillion, according to the suit.

McMillion claims Middleton has failed an refused to pay the balance on its account, despite demands for payment of the balance due.

Middleton breached its contract with McMillion, which caused Middleton to suffer damages, according to the suit.

McMillion is seeking judgment in the amount of $71,960 with pre- and post-judgment interest. It is being represented by Webster J. Arceneaux III and Spencer D. Elliott of Lewis, Glasser, Casey & Rollins PLLC.

The case has been assigned to Circuit Judge Louis H. Bloom.
