CHARLESTON - A lawsuit against Maple Coal Co. regarding a former employee who claimed his employment was wrongfully terminated has been dismissed.
On April 16, 2012, a Final Dismissal Order was filed on Kanawha Circuit Court stating both parties moved to have the lawsuit dismissed as all matters between them had been fully settled, compromised and agreed to. Terms were not disclosed.
On March 29, 2012, a Voluntary Dismissal Order was filed by Earnest Chad Green, through counsel, voluntarily dismissing all claims against Beth Roberts with prejudice.
On March 20, 2012, a mediation session was conducted by Donald B. O'Dell as mediator, and the parties negotiated openly and knowledgeably about the case and a settlement of all claims was reached, according to court documents.
Green had claimed his employment with Maple had been terminated in violation of West Virginia code because he had filed a Workers' Compensation claim when he was injured on June 14, 2010, while on the job.
Green was represented by J. Michael Ranson, Cynthia M. Ranson and George B. Morrone III of Ranson Law Offices and G. Patrick Jacobs of Jacobs Law Offices. Maple was represented by Kurt Entsminger and Briana J. Marino of Flaherty Sensabaugh Bonasso PLLC.
The case was assigned to Circuit Judge Carrie Webster.
