Suit against South Charleston Sanitary Board over hole settled

CHARLESTON - A lawsuit against the South Charleston Sanitary Board regarding injuries a man suffered when he stepped into a deep hole has been dismissed.

On Sept. 28, a dismissal order was filed, stating all matters in controversy between the parties had been fully resolved moved that the Court dismiss all claims arising from the suit with prejudice.

On July 17, 2009, James Jones was out for a walk when he stepped into a deep hole covered by grass and sustained severe injuries, according to a complaint filed Feb. 18, 2011, in Kanawha Circuit Court.

Jones claimed the sanitary board had actual and/or constructive knowledge and notice of the dangerous condition and failed to fix the problem.

On Aug. 30, a mediation outcome report was filed in Kanawha Circuit Court by Frank T. Litton Jr. of Litton Law Office, stating that the parties had resolved any and all issues in controversy during the mediation conducted on Aug. 29.

Jones was represented by J. Michael Ranson, Cynthia M. Ranson and George B. Morrone III of Ranson Law Offices. The South Charleston Sanitary Board was represented by William R. Slicer of Shuman, McCuskey & Slicer PLLC.

The case was assigned to Circuit Judge Louis H. Bloom.
