Man names 60 defendants in asbestos suit

CHARLESTON - A Wheelersburg, Ohio, man is suing 60 companies he claims are responsible for his lung cancer.

William Eugene Miller was diagnosed with lung cancer on April 21, 2011, according to a complaint filed April 5 in Kanawha Circuit Court.

Miller claims the 60 defendants are responsible for the diagnosis.

The defendants exposed Miller to asbestos and/or asbestos-containing products during his employment as a laborer from 1947 until 1995, according to a suit.

Miller claims he smoked cigarettes from 1949 until 1995, but then quit.

The defendants are being sued based on theories of negligence, contaminated buildings, breach of expressed/implied warranty, strict liability, intentional tort, conspiracy, misrepresentation and post-sale duty to warn, according to the suit.

Miller is seeking a jury trial to resolve all issues involved. He is being represented by Bronwyn I. Rinehart of James F. Humphreys & Associates.

The case has been assigned to a visiting judge.
