Man sues Kroger for injuries

CHARLESTON - A Kanawha County man is suing Kroger Limited Partnership I for injuries he claimed he sustained while at its Charleston location.

Rodney Jones, Terra Smyre, Brent Donald and John Doe were also named as defendant in the suit.

On April 5, 2011, Dirar M. Ahmad was shopping at Kroger in Charleston when he slipped on a slick substance in the floor and was injured, according to a complaint filed April 5 in Kanawha Circuit Court.

Ahmad claims he sustained injury to the pelvis joint; sacroiliac sprain; somatic dysfunction neuritis; muscle spasms; leg and knee sprain; hip and thigh sprain; and a calf injury.

The defendants were negligent in failing to properly maintain the interior traffic aisles by neglecting to clean the slippery substance and allowing it to collect and remain in the walkway, which presented a hazardous condition, according to the suit.

Ahmad claims the defendants also failed to warn him and make the area safe for patrons.

As a result of the defendants' negligence, Ahmad suffered great physical pain and mental anguish and has incurred medical expenses, according to the suit.

Ahmad is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Timothy L. Eves of the Eves Law Firm PLLC.

The case has been assigned to Circuit Judge Jennifer Bailey.
