WAYNE - A man who says he was injured when a golf cart overturned is suing Twin Silos of Lavalette LLC for the injuries he received.

On May 29, 2011, Gregory Farley went to Twin Silos to play a few rounds of golf with friends and was driving a golf cart down a hill when the cart reached top speed and suddenly overturned, according to a complaint filed April 22 in Wayne Circuit Court.

Farley claims when the golf cart overturned, it pinned him under the cart and knocked him unconscious briefly.

The incident caused Farley to suffer a wound to his elbow from a length of rebar that was sticking up from the side of the cart path and the left side of his face was bleeding, according to the suit.

Farley claims he also had pain coming from his left shoulder and left arm, which was dislocated and his rotator cuff was torn.

The defendant owed a duty to Farley to exercise ordinary care to keep and maintain the premises of the golf course in a reasonably safe condition and was negligent in breaching its duty, according to the suit.

Farley claims the defendant failed to warn him of the hazards presented by a cable lying on the ground by a yellow marking or in some other manner when it knew or should have known business invitees would have difficulty seeing the cable.

As a result of the defendant's breach of duty, Farley incurred medical expenses; physical pain and mental suffering; and suffered substantial annoyance, inconvenience and aggravation, according to the suit.

Farley is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Donald R. Jarrell of the Law Offices of Donald R. Jarrell.

The case has been assigned to Circuit Judge Darrell M. Pratt.
