HUNTINGTON - A woman is suing Express Printing Inc. for injuries she allegedly suffered after she was involved in a car accident caused by one of its employees.
John L. Rowsey, an employee of Express, was also named as a defendant in the suit.
On May 10, 2011, Janine Murphy was a guest passenger in a vehicle being driven by Bobby Hutchinson when Rowsey, who was acting in the scope of his employment with Express, violently collided with the vehicle she was in and caused her injuries, according to a complaint filed April 17 in Cabell Circuit Court.
Murphy claims Rowsey was operating a vehicle owned by Express and was acting in a negligent and reckless manner when he caused the collision.
Rowsey had a duty to use due care in the operation of the vehicle and failed to do so, which caused the collision that caused Murphy's injuries, according to the suit.
Murphy claims Express had the authority to restrict the persons who were allowed to operate its vehicle and knew or should have known that, due to inexperience and prior actions, Rowsey's operation of the vehicle created an unreasonable risk of harm to others.
As a result of the defendants' negligent acts and/or omissions, Murphy suffered damages, including bodily injury; pain and suffering; loss of enjoyment of life; lost past, present and future wages; and a diminished earning capacity, according to the suit.
Murphy is seeking compensatory damages. She is being represented by Scott D. Maddox of Maddox Law Office PLLC.
The case has been assigned to Circuit Judge F. Jane Hustead.
