CHARLESTON - A man is suing Holiday Inn Express after he says he suffered injuries from a fall while on its property.
Shaner Holdings Limited Partnership is doing business as Holiday Inn Express.
On April 28, 2011, Terence P. Myers was a guest at the defendant's hotel when he fell on an uneven set of stairs and suffered injuries, according to a complaint filed April 15 in Kanawha Circuit Court.
Myers claims the defendant owed a duty of reasonable care to him and breached that duty by negligently failing to provide a safe and secure environment for its guests.
Holiday Inn Express breached its duty of care by negligently creating a dangerous condition or by negligently allowing a dangerous condition to develop, according to the suit.
Myers claims the defendant was negligent in failing to properly implement and/or conduct a reasonable inspection of its premises, which would have revealed the dangerous condition.
As a result of the defendant's negligence and carelessness, Myers suffered a left foot injury and extensive partial tear of the medial collateral ligament of his right knee, incurred medical expenses and endured economic and non-economic damages, according to the suit.
Myers is seeking compensatory damages. He is being represented by JB Akers of Akers Law Offices and S. Ramani Pillai of Buckel Levasseur & Pillai LLC.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
