HUNTINGTON - A Barboursville couple are suing Hager Construction LLC after they claim the home they purchased was defective.

Howmar LLC was also named as a defendant in the suit.

In 2006, Hager constructed a house in Barboursville that Norman Adkins and Charlotte Adkins purchased on July 5, 2006, according to a complaint filed April 24 in Cabell Circuit Court.

The Adkinses claim after purchasing and occupying the residence, they discovered defects in the construction of the home, specifically cracks and movement in the foundation, structural members, trim and finishes.

After the failures and defects manifested themselves, the defendants attempted to repair the damage to the house, but, during the course of attempting to repair the damage due to the defective and faulty construction of the house, the defendants knowingly and willfully also performed work to actively conceal the fact that the structural failures and damage was continuing and ongoing, according to the suit.

The Adkinses claim the defendants breached their contract with them by constructing and providing a house with substantial defects that affect the value, integrity and utility of the house.

The defendants' actions were negligent and fraudulent and caused the Adkinses damages, according to the suit.

The Adkinses are seeking compensatory and punitive damages. They are being represented by John F. Loehr of the Daniels Law Firm PLLC.

The case has been assigned to Circuit Judge David M. Pancake.
