CHARLESTON - A former employee says Continental Surfaces of Charleston LLC terminated his employment in violation of West Virginia code.
Robert Latta Jr. was employed by Continental from March 1, 2011, until Dec. 6, 2012, according to a complaint filed April 17 in Kanawha Circuit Court.
Latta claims prior to Dec. 6, he was injured on the job and as a result of the injury, filed a Workers' Compensation claim, all of which was ruled compensable.
On Dec. 6, Latta's employment was terminated in whole or in part because he filed the Workers' Compensation claim, according to the suit.
Latta claims the defendant's wrongful discharge constituted discrimination because of filing for and receiving workers' compensation benefits.
During his employment, Latta properly performed his job duties for Continental and its actions caused Latta damages, according to the suit.
Latta is seeking compensatory and punitive damages. He is being represented by J. Michael Ranson and Cynthia M. Ranson of Ranson Law Offices and G. Patrick Jacobs of Jacobs Law Offices.
The case has been assigned to Circuit Judge Louis H. Bloom.
