CHARLESTON - A former Cedar Truck Company Inc. employee is suing it, saying her employment was wrongfully terminated after she filed for Workers' Compensation benefits.
On April 1, 2011, Lisa Hill was involved in a motor vehicle collision at work and was injured, according to a complaint filed April 22 in Kanawha Circuit Court.
Hill claims after filing a Workers' Compensation claim for benefits, the defendant terminated her employment.
Cedar terminated Hill's employment on May 19, 2011, in violation of West Virginia code, according to the suit.
Hill claims the defendant also violated the West Virginia Human Rights Act for terminating her employment when she is a female and a member of a protected class.
Cedar's actions were also in retaliation for Hill filing a Workers' Compensation claim, which violated state public policy and caused Hill to suffer substantial damages, including losses in earning and employment benefits; humiliation and embarrassment; and emotional distress, according to the suit.
Hill is seeking compensatory and punitive damages. She is being represented by Lia DiTrapano Fairless of DiTrapano Law Firm and L. Tom Price of Holroyd & Yost.
The case has been assigned to Circuit Judge Jennifer Bailey.
