Former employee says RJ Recycling late with final check

CHARLESTON – A former employee is suing RJ Recycling LLC for allegedly failing to pay her final wages within 72 hours of terminating her employment.

Melissa Hacker was employed by RJ as an administrative assistance until Aug. 27, according to a complaint filed May 2 in Kanawha Circuit Court.

Hacker claims the defendant did not pay her final wages until Aug. 31, which was more than 72 hours after discharge.

RJ had a duty pursuant to the West Virginia Wage Payment and Collection Act to pay Hacker’s final employment wages in a timely manner and breached its duty, according to the suit.

Hacker claims the defendant’s actions caused her damages and entitles her to treble damages.

Hacker is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Todd S. Bailess and Joy B. Mega of Bailess Law PLLC.

The case has been assigned to Circuit Judge Tod J. Kaufman.
