Chemist says WVDOT failed to timely pay final wages

CHARLESTON - A former West Virginia Department of Transportation-Division of Highways chemist says the WVDOT failed to pay his final wages in a timely manner after terminating his employment.

Nicholas C. Nguyen was employed by the defendant from Oct. 16, 1991, until May 16, according to a complaint filed May 2 in Kanawha Circuit Court.

Nguyen claims the defendant failed to pay his final wages within 72 hours of terminating his employment, which violates the West Virginia Wage Payment and Collection Act.

The defendant failed to pay Nguyen’s employment wages on three separate occasions after he was discharged, which caused him damages, according to the suit.

Nguyen claims the defendant’s actions entitle him to treble damages.

Nguyen is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Todd S. Bailess and Joy B. Mega of Bailess Law PLLC and Raymond R. Lovejoy.

The case has been assigned to Circuit Judge Carrie Webster.
