HUNTINGTON - SWVA Inc. is suing SIC Lazaro U.S. Inc. for allegedly failing to pay more than $70,000 for goods and services.
On July 25, SIC made five separate purchases from SWVA totaling $72,155.36 that were shipped on Aug. 9, Aug. 22 and Oct. 1 to SIC's Wisconsin facility and its Huntington facility, according to a complaint filed May 3 in Cabell Circuit Court.
SWVA claims SIC has failed and refused to pay for the goods it shipped to its facilities, which is a breach of contract.
SIC has been unjustly enriched at SWVA's expense by failing and refusing to pay for the goods it received from SWVA, according to the suit.
SWVA claims it is entitled to judgment against the defendant in an amount sufficient to compensate it for the full amount of SIC's unjust enrichment at SWVA's expense.
As a direct and proximate of SIC's breach of its contracts with SWVA, SWVA has suffered damages in the total amount of $72,155.36 plus interest and consequential and incidental damages, according to the suit.
SWVA is seeking judgment in the amount of $72,155.36 with pre- and post-judgment interest. It is being represented by Arnold J. Janicker and Allison Subacz of Jenkins Fenstermaker PLLC.
The case has been assigned to Circuit Judge David M. Pancake.
