HUNTINGTON - A former employee is suing D.L.C. Pizza Inc. for failing to pay her final wages within 72 hours of terminating her employment.
Rachel A. Lawson was employed by D.L.C. from March 8 until March 15, according to a complaint filed May 6 in Cabell Circuit Court.
Lawson claims D.L.C. was required under law to pay her final wages within 72 hours of discharge, but failed to do so.
As a result of D.L.C.'s failure to pay Lawson her wages in violation of the West Virginia Wage Payment and Collection Act, which entitles her to an aware of her wages due, plus interest, according to the suit.
Lawson claims D.L.C. owes her three times her wages due in liquidated damages.
D.L.C.'s conduct caused Lawson to sustain damages, as a result of violating the West Virginia Wage Payment and Collection Act, according to the suit.
Lawson is seeking compensatory damages. She is being represented by George B. Morrone III of Morrone Law.
The case has been assigned to Circuit Judge David M. Pancake.
