Woman sues Nail Time for injury during pedicure

CHARLESTON - A Charleston woman allegedly injured while getting a pedicure is suing Nail Time Inc. and two men for her injuries.

Lan Quoc Tran, the owner of Nail Time, and John Doe, an unknown nail technician, were also named as defendants in the suit.

On June 10, 2011, Beverly A. Chafin went to Nail Time to receive a manicure and pedicure and Tran and/or Doe performed her pedicure, according to a complaint filed May 9 in Kanawha Circuit Court.

Chafin claims as nail technicians, Tran and Doe owed a duty to her to use reasonable and prudent care and to follow all protocols and procedures in performing a pedicure, both prior to and during the performance of the pedicure.

Tran and/or Doe breached their duties owed to Chafin by failing to appropriately screen her prior to performing the pedicure; by failing to use safe and proper tools when performing the pedicure; by cutting Chafin during the pedicure; and/or by failing to follow the proper protocols after cutting Chafin, according to the suit.

Chafin claims the defendants' actions were negligent, reckless, willful and/or wanton.

As a result of the defendants' negligent, careless and/or reckless conduct, Chafin suffered severe injuries and experienced and incurred lost wages and medical expenses; pain and suffering; physical limitations; diminished capacity to enjoy life; annoyance and inconvenience; and other consequences and damages associated with her injuries, according to the suit.

Chafin is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Robert D. Cline Jr., Robert A. Campbell and Jennifer D. Roush of Farmer, Cline & Campbell PLLC.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
