David Francis vs. City of Kenova Police Department
PA- Paula L. Harbour; J- James H. Young Jr.
* Francis was employed by the defendant. He claims he was employed as captain and the highest ranking member of the Kenova Police Department other than the Chief of Police prior to June 1, 2009. From June 1, 2009, until Sept. 29, 2009, the Chief of Police took administrative sick leave and Francis assumed his duties until another Chief of Police was hired. Francis did this again from June 2010 until July 19, 2010, he says. Francis claims the defendant failed to pay him the difference between his wages and the Chief of Police pay during the times he performed those duties. Francis is seeking compensatory damages with pre- and post-judgment interest.

Jamael Hall and Megan Hall; Craig Kiger; Vicki Dunn-Marshall; Charles Steffy and Debra Steffy; and Marshall Rentals WV LLC vs. City of Huntington
PA- John W. Barrett, Jonathan R. Marshall, Michael B. Hissam; J- Darrell Pratt
* The plaintiffs suffered damages after the defendant failed to maintain its Krouts Creek stormwater control system in 2006, 2009 and 2011, and a Wayne County jury concluded in 2010 that the City of Huntington was responsible for property damages, the suit says. A second suit was filed against the City in 2010 for the same flood event after the City refused to maintain the stormwater system and another jury also found the City liable and awarded damages, the suit says. The City's callous conduct has jeopardized the plaintiffs' safety and security in their homes and has caused more damages to their property, the suit says. The plaintiffs are seeking compensatory damages with pre- and post-judgment interest.
