HUNTINGTON - A former employee is suing W.R. Harbour Place for failing to pay her final wages within 72 hours of terminating her employment.

Brenda D. Martin was also named as a defendant in the suit.

Kendra Edwards was employed by the defendants as a daytime cook until her employment was terminated on Oct. 19, according to a complaint filed May 17 in Cabell Circuit Court.

Edwards claims Martin, in her capacity of supervisor/owner was responsible for issuing paychecks for those employed with the defendants and the defendants had a duty pursuant to the West Virginia Wage Payment and Collection Act.

The defendants had a duty to pursuant to the West Virginia Wage Payment and Collection Act to pay Edwards her final wages within 72 hours of terminating her employment, but failed to do so, according to the suit.

Edwards claims she did not receive her final wages until Oct. 24.

The defendants' failure to pay her final wages in a timely manner entitles Edwards to treble damages, according to the suit.

Edwards is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Todd S. Bailess and Joy B. Mega of Bailess Law PLLC.

The case has been assigned to Circuit Judge David M. Pancake.
