Scheduling order filed in medical malpractice suit

POINT PLEASANT - A scheduling order has been filed in lawsuit in which a Point Pleasant man is suing Pleasant Valley Hospital Inc. for medical malpractice.

The scheduling order, which was filed April 10 in Mason Circuit Court, has ordered mediation to occur no later than Sept. 2; summary judgment and other dispositive motions to be filed by Sept. 9; and a pretrial conference set for Oct. 7.

On Oct. 17, 2007, Dr. Harold E. Ayers failed to recognize, diagnose and detect a pituitary tumor and failed to immediately refer James Morrow to an endocrinologist in May and June 2005, and thereafter for treatment of the pituitary tumor and to treat diabetes, according to a complaint filed May 10, 2011, in Mason Circuit Court.

Due to the failure of Ayers to recognize, diagnose and detect the pituitary tumor and failure to immediately refer Morrow to an endocrinologist, he sustained severe injuries and damages, the suit says.

Morrow claims Ayers deviated from the acceptable standard of care by failing to recognize, diagnose and treat the pituitary tumor.

Morrow is seeking compensatory damages with pre- and post-judgment interest. He is being represented by R.R. Fredeking II, Paul E. Biser and William D. Thompson of Fredeking & Fredeking Law Offices LC.

The case has been assigned to Circuit Judge David W. Nibert.
