CHARLESTON - A former employee is suing Valley Center-Genesis Healthcare for failing to pay her final wages in a timely manner.
1000 Lincoln Drive Operations LLC is doing business as Valley Center-Genesis Healthcare.
Christina D. White was a Certified Nursing Assistant with the defendant until May 24, 2012, according to a complaint filed May 3 in Kanawha Circuit Court.
White claims the defendant failed to pay her final wages within 72 hours of discharge.
The defendant did not give White her final wages until June 1, 2012, and Kim Mitchell, while acting in the scope of her employment as an administrator and/or agent of the defendant, promised White she would receive her vacation pay, according to the suit.
White claims to date, she has yet to receive her pay for the unused vacation that she had accumulated during the course of her employment.
The defendant violated the West Virginia Wage Payment and Collection Act, according to the suit.
White is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Todd S. Bailess and Joy B. Mega of Bailess Law.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
