CHARLESTON - A man is suing Synergetic Communications Inc. for failing to provide him with a statement of his account and for failing to identify the holder of his loan.
On Aug. 29, Synergetic sent Michael D. McDermott a collection letter claiming he owed $26,699.19 to United Guaranty, according to a complaint filed May 10 in Kanawha Circuit Court.
On Jan. 31, McDermott sent the defendant a certified letter, requesting information regarding how they had calculated the amount due, a detailed account record of the loan and requesting that they supply him with the name of the holder of the loan.
McDermott claims the defendant has not responded to the request.
The defendant failed and refused to provide a complete statement of default charges to McDermott, in violation of West Virginia code, according to the suit.
McDermott claims the defendant's actions caused him damages.
The defendant, in an effort to collect or obtain information about McDermott, contacted him directly while knowing he was represented by counsel, according to the suit.
McDermott is seeking actual damages and civil penalties. He is being represented by Daniel F. Hedges of Mountain State Justice.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
