Woman sues J.S. Breeden Builders over installation of roof

CHARLESTON - A woman is suing J.S. Breeden Builders Inc. for allegedly negligently installing a roof on her residence.

Design Roofing LLC was also named as a defendant in the suit.

Rhonda L. Jacobs contracted with J.S. Breeden in May 2011 to replace the old roof and install a new roof on her residence, according to a complaint filed May 15 in Kanawha Circuit Court.

Jacobs claims J.S. Breeden subcontracted with Design Roofing to perform the roof replacement and the defendants started and completed the work in May 2011. Thereafter, the roof began to leak.

When Jacobs informed the defendants of the leak, the defendants performed corrective work on the roof, but it continued to leak in the kitchen area and then began to leak in the master bedroom, according to the suit.

Jacobs claims as a result of the roof leaks, his residential real estate has been damaged inside the ceilings in the kitchen area and master bedroom; flooring in both areas; carpet in the master bedroom, walls and electrical sockets in both areas; and the continued roof leak.

The defendants negligently installed the roofing shingles on Jacobs' residential real estate because the defendants negligently failed to follow the shingle manufacturers shingle installation instructions and recommendations, according to the suit.

Jacobs is seeking compensatory damages. She is being represented by G. Patrick Jacobs of the Law Office of G. Patrick Jacobs.

The case has been assigned to Circuit Judge Charles E. King.
