Couple sue GM, claim vehicle defective

CHARLESTON - A couple are suing General Motors LLC for allegedly selling them a defective vehicle.

Mid-State Automotive Inc., American Luxury Coach LLC and Ally Bank were also named as defendants in the suit.

On Nov. 24, Ryan Holt and Leigh Holt entered into a motor vehicle purchase contract with the defendants for the purchase of a 2012 Chevrolet Silverado 1500, according to a complaint filed May 21 in Kanawha Circuit Court.

The Holts claim after purchasing the vehicle, they discovered and experienced repeated nonconformities that substantially impaired the use, value and/or safety of the vehicle.

As a result, the Holts returned the vehicle to the defendants for repairs on at least seven occasions, but the defendants failed to repair the vehicle so as to bring it into conformity with the warranties, according to the suit.

The Holts claim the defendants failed to repair the defective vehicle within a reasonable time period and did not conform the vehicle to all warranties offered by the defendants and refused the Holts' request for a comparable replacement vehicle.

The defendants misrepresented the condition of the vehicle and failed to remedy the problems brought about by the defendants' unlawful conduct in a timely fashion, according to the suit.

The Holts are seeking compensatory and punitive damages with pre- and post-judgment interest. They are being represented by Kristina Thomas Whiteaker and David L. Grubb of the Grubb Law Group.

The case has been assigned to Circuit Judge Tod J. Kaufman.
