WAYNE - A man is suing Wayne Gas Company for failing to abide by a gas lease that allegedly entitles him to free gas for his residence and barn.
Julius Davis owns mineral and gas rights as well as surface lands in Wayne County and claims under the gas lease, he is entitled to free gas for his residence and barn, according to a complaint filed May 28 in Wayne Circuit Court.
Davis claims the defendant has refused to properly maintain the gas wells and has refused to allow him free gas.
Despite repeatedly informing Wayne Gas Company that he is entitled to free gas and that the wells on the property were in disrepair, the defendant has failed to maintain the gas well located on Davis' property, according to the suit.
Davis is seeking a judgment declaring the current validity of his right to free gas for his residence and barn; an order to require the respondent to properly maintain the gas wells or, in the alternative, a termination of the gas lease; and compensatory damages with pre- and post-judgment interest. He is being represented by Gary L. Michels
The case has been assigned to Circuit Judge Darrell Pratt.
