* James Cleavenger seeks damages against Walls Sanitation for injuries he allegedly sustained while driving a Mack dump truck for garbage pickup. He claims the truck was improperly maintained and that the outline line from the fuel filter was loose, causing the cab of the truck to explode. Cleavenger is asking for past, present and future medical expenses and lost wages.

Both were terminated from their jobs and allege they were not paid their wages within the 72-hour period, thus violating the West Virginia Wage Payment and Collection Act.
