CHARLESTON - A lawsuit against Headwaters Resources Inc. was settled and dismissed in Kanawha Circuit Court last year.

Charles Roberts was also named as a defendant in the suit.

Rachel Beckett and the defendants announced to the court that the matter had been resolved and accordingly, the parties jointly moved the court to dismiss the action with prejudice, according to an Agreed Order of Dismissal with Prejudice that was filed June 27 in Kanawha Circuit Court.

Beckett claimed from Aug. 31, 2007, until July 13, 2009, she was employed as an administrative assistant for Headwaters, according to a complaint filed March 10, 2011, in Kanawha Circuit Court.

During her employment, Beckett had made complaints regarding inappropriate conduct by other employees, including sexual harassment.

Beckett claimed the defendants and their male employees used mobile telephones provided by the company to engage in inappropriate telephone calls to Beckett’s mobile telephone and also send "inappropriate photographic images."

Roberts directly retaliated against Beckett after she made the complaints by unlawfully terminating her employment, she claimed.

Beckett was seeking compensatory and punitive damages with pre-judgment interest. She was being represented by Michael A. Olivio and Travis A. Griffith of Olivio & Griffith PLLC.

The defendants were being represented by Richard M. Wallace and Joseph D. Garcia of Spilman Thomas & Battle PLLC.

The case was assigned to Circuit Judge Louis Bloom.
