MORGANTOWN - Two women are suing Valley Comprehensive Community Mental Health Center for allegedly failing to pay their final wages in a timely manner.
Valley Comprehensive is doing business as Valley HealthCare System.
Shelley Weaver and Tesla Hoskins, individually and on behalf of those similarly situated, claim the defendant failed to pay their final wages within 72 hours of discharging them from their employment, according to a complaint filed June 5 in Monongalia Circuit Court.
Weaver and Hoskins claim they seek relief pursuant to Rule 23 of the West Virginia Rules of Civil Procedure on behalf of all persons formerly employed by the defendant at any time in the five years prior to the filing of this complaint through class certification in West Virginia who were discharged and not paid all wages within 72 hours of their discharge.
The defendant failed to pay Weaver and Hoskins, as well as other similarly situated class members their final employment wages in full within 72 hours of discharge, according to the suit.
The plaintiffs claim the defendants violated the West Virginia Wage Payment and Collection Act.
The plaintiffs are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Todd S. Bailess and Joy B. Mega of Bailess Law PLLC; and Rodney A. Smith and Jonathan R. Marshall of Bailey & Glasser LLP.
