WINFIELD - A couple are suing Werner Enterprises for injuries sustained in a car accident allegedly caused by one of its drivers.
Cecil Milton Rudley Jr. was also named as a defendant in the suit.
On May 22, 2011, Jessica Sheridan was lawfully operating her vehicle on W.Va. 34 when Rudley, who was acting in the scope of his employment with Werner, struck her vehicle and caused injuries, according to a complaint filed May 22 in Putnam Circuit Court.
Sheridan claims Rudely negligently failed to maintain control of the 2007 Aerocab and breached his duty to maintain control.
As a direct and proximate result of the negligence, recklessness and carelessness of the defendant, Sheridan and her child, Peyton Sheridan, incurred charges for medical treatments; suffered emotional distress, annoyance, aggravation and inconvenience; and damages to the vehicle and loss of use, according to the suit.
Jessica Sheridan and her husband, Thomas Sheridan, suffered loss of companionship, assistance and services, according to the suit.
The plaintiffs are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Harry F. Bell Jr.
